In this document, we offer you concrete conditions under which Nica.team website and materials can be used. If you unconditionally agree – please continue using it. If not – please leave it as you are not authorized to use it.
The addresses www.nica.team or Nica.team (regardless of capital letters) are used as synonyms. Please direct any questions to info@nica.team if something in this document is not clear and refrain from using Nica.team unless you are satisfied with response.
So, by accessing Nica.team you agree with the followings (hereinafter “Agreement”).
1. Services and Content
1.1. Site, Services, Content
Nica.team provides data (the “Services”) via its website reachable at www.nica.team or synonyms (the “Site”). For the purposes of this Agreement, “Content” includes any written report as well as any information published on Nica.team. Nica.team may suspend, disable or terminate your access to the Services, Site, or Content without a notification.
1.2. Updates
Nica.team may modify the Services, Site, or Content at any time.
1.3. Effective Date
This Agreement is effective from the moment you use the Site.
2. Users
2.1. Requirements for Use
You may register for a single user account using a unique username and password if such option is provided or log in using your current social media accounts. You can add additional information about yourself by entering it on your personal page on Nica.team.
By using the Site you agree that you have read, understood, and consented to the terms of the Nica.team Privacy Policy (“Privacy Policy”), which is available for your review on the Site. Nica.team may amend the Privacy Policy at any time without notice. Please visit it regularly.
2.2. Responsibility for Use
Your account username and password or access through social networks are solely for your individual use to access the site and you may not permit anyone else to use them or your account. You are responsible for all use of the Site, Services, and Content accessed with your credentials (including any illicit use of your user ID or password). Please prevent such unauthorized use.
2.3. Reporting Unauthorized Use or Access
If you believe there has been unauthorized access or use of the Site or of any Content with your account credentials, you must notify Nica.team immediately by emailing to info@nica.team.
3. Prohibited Usage
3.1. No Uses Competitive with Nica.team
You agree not to use the Content in furtherance of a Competitive Product. A “Competitive Product” is a product or service that provides customers with data that is substantially similar to data made or gathered from different sources by Nica.team. The Content may not be used for any competitive analysis as well.
3.2. No Technological Attacks or Scraping
You may not use or attempt to use any deep-link, scraper, robot, bot, spider, data mining, computer code or any other device, program, tool, algorithm, process or methodology to systematically access, acquire, copy, or monitor any portion of the Content or Site.
3.3. No Violations of Third-Party Intellectual Property
You may not use the Site, Services, or any Content in a manner that infringes or violates the intellectual property or proprietary rights of Nica.team or any third party.
3.4. No Use in Violation of Laws
You may not use the Site or Content in any manner that is unlawful or that harms Nica.team. Additionally, You may not use the Site or Content in any way that is fraudulent, false, or deceptive.
3.5. Nica.team Intellectual Property Marks
You must not remove or obscure the copyright, trademark, service mark, or other notices contained in the Site, Services, or Content, regardless of whether such notices relate to rights possessed by Nica.team. You may not use the trademarks, service marks, logos, or other proprietary identifiers of Nica.team without prior written consent or unless otherwise is implicitly stated by this Agreement.
4. Reservation of Rights
4.1. Except as detailed below in this Section, all rights—including all copyrights and other intellectual property rights for Services, Site, Content, belong to Nica.team and cannot be used without its proper written permission. If you need one, please feel free to email us on info@nica.team and get it!
4.2. User Data
Nica.team does not claim an ownership interest in any data or content not originally sourced from Nica.team and that is separately uploaded by Users or gathered from open sources. Users grant Nica.team the right to display Users’ data as needed to provide the Services.
4.3. Statistics
Nica.team gathers statistics from open sources or gets it from its partners like moot courts, law schools, etc. Such information is not an object of copyright, however, is protected as industrial property over databases.
4.4. Achievements (aka Badges)
Nica.team publishes badges in section “Achievements” on each law school’s page if such badges are awarded. Law schools, as well as anybody else, are welcome to publish such badges on their web-sites, social networks on in other electronic means of communications or publications if and only if they provide the link to the relevant page of Nica.team or Nica.team home page making the relevant badge clickable. If the badge is published in a form that doesn’t allow to make a hyperlink then reference to Nica.team should be made in written. It is also the responsibility of the user not to mislead other users/observers/visitors/readers and publish the badges the way that exclude any misunderstanding about which university was awarded the badge. Design and proportions of badges cannot be changed, however, it is allowed to enlarge or reduce them in size.
Badges of the current year reflect the current situation (that changes regularly) in the ranking and that is why they additionally should be accompanied by the word “anticipated” and indication of the date when they were taken from Nica.team website.
To publish your laws school badge you are allowed to download the Badge and use it as picture that hyperlinks as described above in the first paragraph.
4.5. Wikipedia and open sources information
Nica.team does not claim any rights to descriptions of laws schools or competitions (usually taken from open sources). All such information can be freely used by users if a proper copyright reference is made.
4.6. Publications
You can freely quote Nica.team website if the hyperlink (or reference when hyperlinks are not applicable) is made to Nica.team. We ask you to reference to Nica.team in any case of making a quotation.
5. Notes and Files added/uploaded by Users
The Site functionality provides individual Users with the ability to upload Data. Nica.team has no control over the content of any User and accepts no responsibility for its accuracy, completeness, or timeliness. User remains solely responsible for any use it makes of the Data, and for ensuring that the Data complies with all applicable laws and regulations and does not violate the rights of any third party.
6. Links to Third-Party Sites
The Site may contain links to other web sites (“Linked Sites”). The Linked Sites are not under the control of Nica.team and Nica.team is not responsible for the contents or operation of any Linked Site. Nica.team provides these links only as a convenience, and the inclusion of any link does not imply endorsement by Nica.team of the Linked Sites or any association with its operators.
7. Applicable Law and Court
Law of Ukraine is applicable to this Agreement. In any case of a disagreement the due diligence out-of-court settlement through negotiations should take place. After that being not effective any dispute, controversy or claim arising out of or relating to this Agreement, including the conclusion, interpretation, execution, breach, termination or invalidity thereof, shall be settled by the Commercial Court of City Kyiv (Господарський суд мiста Киэва) in accordance with its Rules.
